Important Claims Deadlines and Workers Compensation in Denver

March 15, 2017

When you need to file for workers’ compensation in Denver, there is a timeline of events you must follow to ensure your case is reviewed. Given that you will not want to pay out of pocket for your injury, it is best to know what to do in the event of an emergency. From tasks you will need to do as soon as possible post-injury and what to expect throughout the process, to which doctors you will need to see, there is a lot of information to know. By following these go-to deadlines and tips, you’ll be on track.

Tasks Immediately After Injury

If injured on the job, you must report it to your employer as soon as possible. Next, you must be able to submit a written report to them within four days of the accident. Ideally, you will want the written report to be completed as soon as possible but in some cases, you are unable in the moment. Your safety is the most important so if you are unable to write up a report the same day, there is a little bit of leeway there. As you file the report, use specifics as far as the areas in which your injury is referring too. This will help the insurance company as they are reviewing the case. Being specific in how the injury took place will also help too. When putting together the claim, be sure to keep a copy. The longer it takes to submit a claim can be subtracted from potential benefits you may receive, so make it a top priority to get this done within the four day window. If you are unable to file the report yourself due to injury, someone can file it for you on your behalf.

What to Expect

Once your claim has been turned in, your employer has 10 days to report your claim to the insurance company. They will also refer you to the medical provider that you will need to see to be examined. It is important that you use their provider so any benefits are covered. Workers’ compensation will only go towards the provider they specify. Once your employer has submitted your claim to the insurance company, they have 20 days to review your claim and come back with a response. If your claim is approved, the Colorado Department of Labor and Employment explains in their Workers Compensation Frequently Asked Questions that you will be paid two-thirds of your average pay.

Temporary Disability

If you miss more than three shifts or days at work due to your injury, you may be able to receive temporary disability. There are two kinds: Temporary Total and Temporary Partial. Temporary Total Disability, this occurs when you are unable to work completely. For Partial Disability, this occurs when you may be able to return to work but must have reduced hours as you heal from your injury.
